TERMS OF SERVICE

Please read these Terms of Service ("Terms") carefully before using our Call Recording App ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. ACCEPTANCE OF TERMS

These Terms constitute a legally binding agreement between you ("User", "you") and Nitish Shah ("we", "us", "our"). These Terms apply to all users of the App, including free and paid subscribers.

2. ELIGIBILITY

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use this App. By using the App, you represent and warrant that you meet this requirement.

3. DESCRIPTION OF THE APP AND SERVICE ARCHITECTURE

The App functions primarily as a Management Dashboard. It provides the following features and utilizes third-party infrastructure to deliver them:

    Call Routing & Infrastructure: The App itself does not natively participate in, intercept, or record live phone calls. Call connections and recording functionalities are handled entirely outside the App binary via standard, carrier-level conference call routing managed by our telecommunications infrastructure partner, Telnyx LLC.

    Dashboard Management: The App provides a secure management panel to organize, view metadata, and stream completed audio recordings securely hosted via our infrastructure.

    AI-Powered Transcriptions: The App provides an on-demand transcription feature powered by AssemblyAI, Inc. This service is completely optional and is only initiated upon explicit, active user consent within the app interface.

    Authentication & Billing: Includes phone verification via Google Firebase Phone Authentication and premium subscription tier enforcement via RevenueCat and the Apple App Store.

4. USER ACCOUNTS AND AUTHENTICATION

You must provide a valid phone number to register and use the App. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account if we suspect fraudulent, abusive, or unauthorized activity.

5. CALL RECORDING — LEGAL RESPONSIBILITY & AUDITORY DISCLOSURES

YOU ARE SOLELY AND ENTIRELY RESPONSIBLE FOR COMPLYING WITH ALL APPLICABLE LAWS GOVERNING CALL RECORDING IN YOUR JURISDICTION AND THE JURISDICTIONS OF ANY CALL PARTICIPANTS.

Call recording laws vary significantly globally. Many jurisdictions require the consent of all parties to a call before it may be recorded ("all-party consent"). Failure to comply with these laws may result in civil actions or criminal penalties.

To assist with compliance, our external telecommunications routing system plays an automatic auditory disclosure warning over the telephone line to all active parties when recording initiates. However, by using this service, you explicitly agree to:

    Ensure all necessary verbal or written consents are established where required by law.

    Not utilize the infrastructure to record calls in violation of any applicable federal, state, local, or international law.

    Accept total and exclusive legal liability for any audio captured using the system.

We expressly disclaim any and all liability for unauthorized or illegal recordings made through the infrastructure.

6. PROHIBITED USES

You agree not to use the App to:

    Record calls without legally required consent.

    Harass, threaten, stalk, or harm any individual.

    Violate any applicable law or regulation.

    Infringe the intellectual property rights of any third party.

    Attempt to gain unauthorized access to our infrastructure, servers, or another user's account dashboard.

7. SUBSCRIPTIONS AND PAYMENTS

Certain features of the App require a paid subscription, managed through RevenueCat and processed by the Apple App Store.
a) Billing

Subscriptions are billed in advance on a recurring basis (weekly, monthly, or annually, depending on the plan selected). Payment is charged to your Apple ID account at confirmation of purchase.
b) Automatic Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.  
c) Free Trials

If a free trial is offered, any unused portion of a free trial will be forfeited when you purchase a subscription.
d) Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds or credits for partial subscription periods.

8. INTELLECTUAL PROPERTY

All content, dashboard features, layout designs, and source code of the App are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for its intended administrative dashboard purposes.

9. PRIVACY AND THIRD-PARTY PROCESSING

Your use of the App is also governed by our Privacy Policy, which outlines our data sharing policies with vital functional sub-processors (Google Firebase, Telnyx, AssemblyAI, and RevenueCat). By agreeing to these Terms, you acknowledge that text and audio processing permissions apply as detailed in the Privacy Policy.

10. DISCLAIMERS

THE APP AND ITS POWERED INFRASTRUCTURE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

    Telecommunication line connections will be entirely uninterrupted, error-free, or compatible with all regional network carriers.

    Audio recordings or transcriptions will be permanently preserved or accessible indefinitely on your dashboard without independent user backup.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

    Loss of recordings, call data, or text transcriptions.

    Legal civil or criminal liability arising from your failure to establish legal recording consent.

    Unauthorized access to your account verification details.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US VIA THE APP STORE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Nitish Shah and any associated operators from any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of your recording of calls without required participant consent, or your violation of any applicable local communication privacy laws.

13. TERMINATION

We reserve the right to suspend or terminate your access to the dashboard at any time, without notice, for any material violation of these Terms or for illegal platform activity.

14. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
